When a product is manufactured and then launched into the market for the sale, there are few important factors which must be followed for the safety of the products. This type of the accountability is called product liability. Distributors and the manufacturers are all responsible for giving safeguards to the products which must be kept intact and fresh. Frankly speaking, before distributing the products for the sale, these products must pass the quality control department. As per the American product liability law, if any consumer purchases the defective product from the retailer or seller, he can file lawsuit against the company or the distributor for recompense. The state laws are at variance with the different states.
The Uniform Products Liability Act or MUPLA has been designed keeping in mind the requirement of people. There are certain sections under which a distributor or producer of the products can be blamed or charged for the defective or low quality products. For instance, any technical defect which was not detected or surfaced before dealing will be a minus point and a consumer can bring allegation against the manufacturer. Secondly, breach of contract. If there is any guarantee with the purchased product, it is proved defective and faulty. Then it is up to the consumers to lodge complaint against the distributor. If the distributor or manufacturing company doesnt replace or change the defective product, he or she can knock at the attorney for filing the case to get the compensation.
Often it is found that the manufacturer or sellers forget to mention certain risky factors in using the product. There is no specific guideline or statutory warning on the label of the product. For instance, if it is wine, detergent, phenyl, or a pack of cigarettes, there should be some statutory warnings about the usage of the products. If the instruction is not given clearly, customers can seek for clarification ventilating grievances in the redressal forum under the consumer act. Frankly speaking, without the help of the lawyer, it is not possible to get the legal victory over distributor or the accused company. Therefore, it is very essential to find out competent lawyer who is very experienced in the particular area of product liability law. One should hire an efficient attorney who will frame the case on the basis of the strong evidence and legal proofs. To select the product liability lawyer, a person needs to consult the seniors, friends and other respectable persons. A vast internet search is also very useful to opt for the attorney who will provide the free legal consultation to his clients and also charge limited fees to file the case in the court.
A manufacturer also has a duty to warn potential consumers of
dangers associated with a product that seem obvious. Failure to do
any or all of these things may result in injury or death to one or
more consumers. A product liability lawsuit is an effective weapon
against unreasonably dangerous products. As a result, a
manufacturer is made aware of the potential danger and the cost of
injuries a defective product may cause.
On Dec. 27th 2003 had a Gorilla Ladder, model # AL-13, extended to 13 feet rested on 8 foot eave edge. Base of ladder rested on level dry concrete. It was around noon and temperature was in the low 40 degrees Fahrenheit. For reasons unknown, Ladder base slid out while being climbed. It is suspected that the plastic material installed at base of ladder shoes is composed of a hardened material that is highly subject to slippage during cool weather. In addition the surface area of the boot that actually comes in contact with the ground surface is only about 1/16 of an inch. The boot of the ladder does not swivel our rotate to compensate for angle of ground level. Purchase of this ladder should be avoided until a time that the manufacturer " TRICAM Industries", can correct this unsafe product flaw. This ladder is widely sold through Home Depot Stores at the discounted rate of $99.00. This ladder should be recalled but it is still being sold to the public and business. The problem noted has been brought to the attention of the foreign manufacturer, "TRICAM Industries", they refuse to pull the product over only a couple injuries. If you have encountered or know of anyone who has encountered a fall or any injuries from the use of this ladder? please post the information on this message board so that this safety matter can be more readily addressed by the manufacture and to prevent future additional injuries from occurring from the use of this unsafe product.
